As you already guessed, the current design determines the date from
the 'Received' header before attempting to rely on the 'Date' header.
 Below you'll find the code documentation from that particular
functionality:

        //Determine the date to associate with the message. Use the date
        //the message was recieved in preference to the date is was sent
        //(because mail clients can be configured wrongly, and we don't
        //want messages from 2072 but recieved in 2002 showing up as 2072
        //in our archive). Use the sent date only if we can't determine
        //the recieved date, and if all else fails, guess at the date.

Therefore it's not a bug, rather a design choice. I would be curious
to know about any advantages we could gain by relying on using the
'Date' header. Out-of-order emails as you mentioned are messages where
'Received' and 'Date' are fairly distinct, which more or less tells
you that either of those headers is bogus, most likely the 'Date' one.
